Frank Gashumba To Take Army To Court Over illegal Detention

Lawyers representing Frank Gashumba and his brother Innocent Kasumba have filed a suit against police and army, citing “unlawful, illegal and unconstitutional” detention of their clients.

The duo is being held at Special Investigations Unit in Kireka.

Gashumba is being held over fraud.

The duo’s lawyer Denis Nyombi in the Suit to the chief magistrate’s court of Nakawa says the continued detention of Gashumba and Kasumba is “unlawful, unjustified and unconstitutional.”

Basing on that, he says, the case involves “this Honourable court to secure their release.”

Gashumba was arrested on October 30 while Kasumba was arrested on October 28, 2017.

When Nyombi on November 1 tried to interact with his client, according to documents obtained by this website, “he was denied access.”

“The duo were also denied police bond without any reason and yet no charges had been preferred against them,” reads Nyombi’s Suit in part.

The lawyer also avers that his clients have not been produced before court “within the constitutionallyprescribed time.”

The case is targeting the director CIID-Kibuli, Chieftaincy of Military Intelligence, Mbuya and the Commandant Special Investigations Unit – kireka.
