Lawyer Mabirizi Challenges Museveni’s Bail Reforms

Lawyer Male Mabirizi has taken the high way to challenge the bail reforms proposed by the president. He has run to the civil division of the High Court in Kampala for an application for judicial review against the cabinet decision to derogate the right to bail and bond for suspects.

According to him this was illegal and didn’t follow the process as it should. Lawyer Mabirizi says the attorney general took an oath to protect the constitution.

However, taking part in this process is against everything he swore to do.

“Cabinet, which swore to protect the Constitution has no function to initiate, introduce and transmit proposals intended to derogate fundamental human rights and freedoms. cabinet did not carry out reasonable stakeholder and public participation, in the circumstances, before arriving at the decision.”

Mabirizi wants court to issue an order of prohibition to stop this as soon as possible.

“Court should be moved to issue an order of prohibition prohibiting Parliament or any Ugandan government official or agency from dealing with implementing the Cabinet memorandum titled “Release on police bond or court bail proposing prohibition of bail for persons facing charges triable both by Magistrates and High Court or only by High Court and increasing the time of being in custody before presented in Court from 48 hours to 48 business hours.”

Mabirizi has filed so many cases as we speak. They all have weight in them but how is he going to handle so much in a short time. He recently filed a case in the East Africa Court.

The case is against president appointing judges using names he did away with last year after becoming Yoweri Tibuhaburwa Kaguta Museveni.
