UPDF Captain Accused Of Murder Faces Possible Conviction

A UPDF captain who is facing accusations of killing an Eritrean businessman might be convicted after advice from two court assessors. The soldier kidnapped the businessman from Kololo in Kampala. They later his charred body at the Uganda-Kenya border of Busia.

Many know the UPDF captain as Bumali Mangeni aka Akeem. They accuse him of killing Daniel Michael Weldu, an Eritrean national.

The assessors, Ms. Asiat Namirembe and Mr. Simon Okongo delivered their joint opinion to the court on Friday. They said the prosecution led by Mr. Jonathan Mugwanya proved beyond reasonable doubt that the captain killed Daniel.

Capt. Bumali is jointly charged with two civilians; Benon Duncan Lumu and Andrew Kisitu.

These three face charges of murder, kidnap with intent to murder, and aggravated robbery of Weldu. Weldu’s abduction happened on October 27, 2016.

The deceased, a former resident of Muyenga, owned a business both in Uganda and South Sudan. He also had an office at Nakumat Mall.

‘’Accused number two (Lumu), confessed to this court that he was there when the murder of the deceased (businessman Weldu) occurred. This was proved beyond reasonable doubt. I find A1 (Lumu) and A2 (Capt. Bumali) guilty and should be convicted accordingly,’’ assessor Namirembe told the court on Friday.

She also added requesting that the court acquits the accused number 3, Mr. Kisitu.

The assessors’ advice is a layman’s opinion to court upon following a given criminal case. The opinion from an assessor, however, does not bind the court, as the judge can choose to disregard it.

After the opinion from the two assessors to court, Justice Anglin set May 14, 2021, to pass her verdict.

This will be one of Justice Anglin’s last verdicts as she is heading out of the judiciary after clocking the retirement age of 65 earlier this year.
