Abuse Of Office Drags Uganda Railways Officials Back To Court

A legal officer at the Uganda Railways Corporation (URC) is being charged with abuse of office. This is over the allegations of mismanaging the procurement process. The accused is expected in court on Tuesday, November 28, 2023.

In her first appearance in court, Grace Opoka Amony appeared before Senior Principal Grade One Magistrate Abert Asiimwe. This happened at the Anti-Corruption Court in Nakasero, Kampala, facing charges of abuse of office.

The magistrate however adjourned the case to November 28 for mention. He gave this time to enable the prosecution to update the court on the progress of inquiries into the issue.

Amony faces the charges together with senior procurement officer Tom Kimera and senior HR Officer Maliza Mukembo Tibewolwa.

The three were all charged under section 11 (18 of the Anti-Corruption Act of 2009 with abuse of office. Amony denied the charges and she got freed on a cash bail of Shs2 million as her fellow accused.

The Charges:

The trio is accused of allegedly acting arbitrarily to the interest of their employer in June of 2020, in their respective offices. According to the prosecution, the accused abused their offices when they allegedly approved that Deloitte Uganda Limited satisfied the eligibility to provide consultancy services.

The accused then contracted Deloitte Uganda Limited to conduct the recruitment of the managing director of URC. The accused, in doing so contradicted the laws and procedures governing the procurement of such public services in Uganda.

Under section 11 (1) of the Anti-Corruption Act 2009, any person found guilty of the offense of abuse of office is liable to 7 years in jail. That or a fine not exceeding shs2.9m or both. Under section 46 of the Anti-Corruption Act, someone convicted of abuse of office is banned from holding public office for 10 years.
