NFA Sued Over Shs200m Contestrd Land In Namanve

The National Forestry Authority has been sued by a logistics company Liberty ICD Ltd. This is for leading to the cancellation of its land title in Namanve worth more than Shs200m.

Liberty ICD Ltd seeks court to declare that the certificate title of land on Plot 1425 block 113, Kyaggwe Road at Kolo Nantubulirwa is valid.

Furthermore, the company says that the land in question is not part of the Namanve Central Forest Reserve.

“A declaration that land comprised on Plot 1425 Block 113 does not form part of compartment II which is alleged to be part of Namanve Central Forest Reserve”. June 28 court documents read in part.

According to the NFA though, a number of plots including the one allegedly owned by the suing company partially fall inside compartment II. These are part of Namanve Central Forest Reserve and Namanve wetland.

Court documents have also shown that Liberty ICD Ltd is the registered proprietor of the land. This is after purchasing it from Mr Wycliff Kawalya.

More to that, there is proof that before buying the land, the company inquired from the land office. From this inquiry, they  discovered that Mr. Kawalya owned the land.

“However, in a March 31 letter,  the commissioner land registration wrote to the plaintiff contending that the certificate of land title was issued without following the right procedure and without the consent of the NFA,”  the plaintiff states.

Consequently, the commissioner land registration resolved to cancel the land title.

The company, through its lawyers seek to have court restrain NFA and the commissioner land registration from effecting changes in the register by cancellation of the certificate of the land title in question. They are also seeking damages, interest, and costs of the lawsuit.
