Court Summons Archbishop Kaziimba Over Luweero Bishop Nullification

The Archbishop of the Church of Uganda (COU), Dr. Stephen Samuel Kaziimba Mugalu, is among the 37 bishops summoned over the nullification of the Luweero bishop.

They are required to defend themselves in a lawsuit concerning the cancellation of Rev. Canon Godfrey Kasana Ssemakula’s election.

He was poised to be the fourth bishop of the Luwero Anglican Diocese. The High Court in Luwero issued summons to these bishops, requiring them to file their defense.

Ssemakula’s election was nullified on June 28, 2023. This was just 16 days before his consecration and enthronement by the House of Bishops.

The case was filed by four Christians in Luwero on December 11, requesting the court to declare Ssemakula as the duly elected 4th Bishop of Luwero and order his consecration.

The also asked court to issue a permanent injunction restraining the defendants from electing another Bishop of Luwero Diocese.

On December 20, 2023, the court issued summons to the bishops, giving them 15 days to file their defense. The bishops can choose to submit a joint defense or file individual defenses based on their preference.

The lawsuit specifically targets bishops who were in office as of June 28, 2023, including two retired bishops. The plaintiffs hope that the court will rule in their favour and declare the actions of the bishops as incorrect.

The plaintiffs are also requesting a permanent injunction that would prevent the House of Bishops from convening to elect another bishop, except for Bishop reverend. Erasto Kibirango, the counsel representing the plaintiffs, expressed confidence in the outcome of the case.

“We hope that the court will recognize the injustice committed and provide the necessary remedies. Our aim is to establish the legitimacy of Bishop Cassana’s appointment and prevent any further unauthorized bishop elections,” he stated.

This legal dispute has gained significant attention within the Church of Uganda and the wider Christian community.

Many will closely follow the proceedings as they unfold, awaiting the court’s decision on this matter. This case holds importance for the Royal diocese and the Church as a whole.

It is important to note that the Church of Uganda has not yet issued an official statement in response to the lawsuit. The bishops named in the case have not made any public comments regarding the matter.
