Minister Judith Nabakooba had put up a challenge on this. Bagala beat Lands Minister Nabakooba in the January 14 polls last year for the Mityana Woman MP position.
Last year, the High Court in Mubende ruled that there was voter bribery and multiple voting during the January 14 polls in Mityana. Apparently, Bagala or her agents committed all these.
These acts are obviously non-compliant with the electoral laws which prompted the presiding judge to order a fresh election thus throwing Bagala out of parliament.
Joyce Bagala also decided to appeal in the same court which on Friday ruled in her favour. The panel consisted of three justices; Geoffrey Kiryabwire, Stephen Musota and Christopher Gashirabake. They ruled that it was wrong for the court to throw Bagala out of Parliament.
“Both the quantitative and qualitative tests should have been applied in the filing of the non-compliance with electoral laws by Nabakooba. The claimant however didn’t show how the non-compliance would have changed the outcome of the election results,” the justices ruled.
“The main appeal(by Bagala) is upheld and the decision of the trial court annulling the election of the appellant as Woman Member of Parliament for Mityana District is set aside.” they added.
Bagala happy said she had won this election onset.
“I have been telling you we won this election. Someone petitioned and said we come to court. So we came to court and I have again defeated that person. I’m sure right now, she is very calm and understood that I defeated her. It’s now time to serve the people of Mityana.”
