Ministry Of Justice Flouted Procurement Laws In Awarding Shs 256bn Contract – Report

The contracts committee at the Ministry of Justice and Constitutional Affairs has trashed the procurement process in awarding a shs 256bn contract.

This contract would see the construction of premises intended to house the Justice Law and Order Sector (JLOS).

Apparently, the committee discovered some irregularities in the bid evaluation process which suggested error. The error could have been intended to favor a particular contractor, of which, 10 companies had submitted bids to the committee.

The initial stage eliminated three companies, and the rest were subjected to rigorous technical evaluations. At that stage, they also eliminated three of the remaining seven companies on technicalities.

The lowest bidder of the remaining four happened to be Seyani Brothers at shs256bn. China Railway Construction followed at shs 294bn. China National Aero Technology came third at shs 299bn and China Sino-hydro at shs 531bn.

On that basis, the bid went to Seyani Brothers. However, it is not clear how their quotation went from the previous shs 241bn to shs 256bn.

The committee found that ministry officials flouted the bidding law which empowers the contracts committee to invite a technical person to clarify on the submissions.

In this case, the report accuses the evaluation committee at the ministry of Justice of blindsiding some of the bidders.

For example, whereas they sought clarification from two of the bidders concerning their bid documents, they never contacted two other companies.

This is in contravention of Section 43 A and B of the PPDA Act. The committee declared the procurement process marred by ‘’incurable irregularities’’ and the contract awarding henceforth canceled.
