Supreme Court Judge’s Candid Account Of Declining To Halt Judgment For Shs 120bn Ham DTB Loan Case

In an unprecedented move, a Supreme Court judge Percey Night Tuhaise recently shed light on her refusal to halt the delivery of judgment in the high-profile Shs 120bn Ham DTB loan case.

According to the judge, the decision to proceed with the judgment was made to maintain the integrity and impartiality of the judicial process.

She explained that the court needed to ensure that justice is not delayed unnecessarily, keeping the spirit of fairness and transparency alive.

But that’s not all!

The judge went on to clarify that halting the delivery of judgment could potentially set a dangerous precedent, where cases could be endlessly delayed, causing frustration and hindering the wheels of justice.

She further emphasized the importance of upholding the rule of law and maintaining public trust in the judicial system.

Meanwhile last month the judge had dismissed an application by Ham but didn’t give reasons for the same.

Following a detailed ruling this week Supreme court judge Tuhaise explained each party was invited by the panel to state whether they had anything to add on to their submissions and that both sides through their lawyers adopted their submissions and that there was nothing new to add on.

She further noted that this is the reason she refrained from going deep into the submissions from both sides which would make her delve into the merits of the two applications.
