Court has this morning ordered the army and all security personnel to vacate Kyagulanyi’s premises. It says this is illegal and not actually allowed. Robert Kyagulanyi alias Bobi Wine has been under house arrest since the 14th of January.
The security agents said his home was under seige due to rumors of him causing chaos after the elections in protest of the results.
There has been a lot going on apparently including Kyagulanyi and his family going short on food. At some point, police didn’t allow even visitors to visit him including his lawyers.
When the efforts to see their counterpart failed, they decided to run to the courts of law. Indeed it has worked as Justice Michael Elubu, the high court judge ruled in their favor saying the detention is illegal.
“The continued indefinite restriction and confinement of the applicant (Kyagulanyi) in his home is unlawful. And in the result his personal liberty has been infringed”. Justice Elubu ruled.
He advised the state to come with evidence of their claims that Kyagulanyi wanted to stage protests. And indeed if it is true, legal procedures should be followed.
“These are all serious allegations of grave offences and it would be proper to follow the due process of the law in regards all the allegations made against the applicant. The due process is defined as conducting criminal proceedings against the applicant.”
“The restrictions put on the applicant are unlawful and order that they are lifted. Consequently and order for personal liberty of the applicant is hereby issued.”
The NUP spokesperson’s response;
