Constitutional Court Dismisses Petition Challenging Polygamous Marriages

Uganda’s constitutional court dismissed an appeal which was filed by MIFUMI an international NGO that revolves around protection of children and woman experiencing violence as well as opposing polygamous marriages.

MIFUMI is against polygamous marriage saying that it’s unconstitutional whereby it violates the assurance of marriage equality as stated under constitution, Article 21(1).

As of yesterday, 5 different judges led by Owiny Dollo Alfonse, the current Deputy Chief Justice dismissed the appeal on the small detail after petitioners appeared unserious to proceed with the matter.

MIFUMI’s lawyer, Mr Rwakafuuzi Ladislaus told them that Mr Mularira Umar Faisal, the lawyer representing UMLS ( Uganda Muslim Lawyers Association ) wanted to join the case as an associate of Court.

Where has Mr Mularira Umar been for all those years? It’s now 8 years since the case was registered, ‘the magistrates were wondering.

Therefore, because of those background issues, without wasting time, the judges decided to get it dismissed.
