In 2020, Kibalama told the High Court in Kampala that he never sold his party to Robert Kyagulanyi. He also said that the NUP members had forged minutes of the meeting that purportedly saw the political party change hands.
However, in a petition to the High Court in Kampala, Kibalama together with Ssimbwa Paul Kagombe, the NURP Secretary-General says the government forced them to make the statements as seen in court against their will. Justice Musa Ssekaana later dismissed the petition.
Kibalama said Difasi Basile and Hassan Twala called him on 20th August 2020. The two were complaining about the transfer of the party leadership. He then set out to meet the duo.
‘’I informed Ssimbwa that I had been invited to a meeting with Prosper Busingye. We agreed to meet the following day at Hotel Sojovalo in Lubaga with other stakeholders and this was scheduled for 8 am,’’ Kibalama says in his affidavit.
He says the two later went for the meeting where they sought an adjournment in the court case. This was in order to reach an amicable solution but the duo declined the same. James Byamukama and Busingye together with armed escorts were available at this meeting.

He said they declined this and insisted that the president of Uganda had instructed them to get Ssimbwa and Moses Kibalama himself to work with them on the case. The two then informed them that two other government officials would meet up with them. This they said is to affirm the position of the government on the matter.
According to an affidavit, they later called them into another room at Sojovalo Hotel. While here, they met the former Internal Security Organization Boss, Col. Kaka Bagyenda.
Kibalama said Kaka told them he had picked interest in them for purposes of winning the court case. He further told them they had to cooperate by providing all information they request.
After all that, they took them to G Hotel in Lubaga and their rooms security personnel surrounded their rooms. At this point, Kibalama knew they were in deep trouble.
‘’Our phones were taken from us and switched off to keep us from communicating to people outside the building. Instead, we were given new phones and numbers. They never allowed visitors to see us, neither were our next of kin nor lawyers and personal doctors. We stayed in the hotel rooms for weeks,’’ Kibalama said.
Kibalama and Ssimbwa want the court to declare that the several government officials mentioned in the affidavit violated the duo’s rights guaranteed under the constitution of Uganda.
