The Kayunga Imam was in 2007 removed from office by a section of Muslims. They accused him of mismanaging mosque affairs.
Subsequently, Sheikh Ssebisubi and UMSC (as plaintiffs) jointly dragged seven Muslims to court over unlawful removal from office. The defendants (sued Muslims) included; Sheikh Kassim Nsubuga, the acting Imam of the mosque. Mr Sowedi Edirisa, Mr Asuman Sotya, Mr Sulaiman Ngabo, Hajji Asuman Ssekajja and Sheikh Abdunulu Songo.
In her Friday judgment, Ms Nambozo noted that from the evidence on record, the first plaintiff (Sheikh Ssebisubi) was removed from office by the county Sheikh Haruna Matovu after complaints by Muslims at his mosque.
“But this act (removal from office of Sheikh Ssebisubi) was later reversed by a letter from the same Haruna Matovu. This was not heeded by the defendants as they failed the whole process of reinstating him. I find that the defendant’s actions were unlawful,” the Magistrate’s judgment reads in part.
“A permanent injunction is hereby issued stopping the defendants from interfering with the management and running of the activities of the mosque by the defendants or their agents,” Ms Nambozo further held.
The Magistrate further ordered the defendants to pay a sum of Shs4m. This is in damages as compensation for tort or breach of contract.
“The plaintiff was inconvenienced by the defendants’ acts from the time the second plaintiff (UMSC) authorized his return to the office to date as they carry out functions they are not mandated to do. In that regard, I award the 1st plaintiff (Sheihk Ssebisubi) Shs4m in damages,” she ruled.
Consequently, Sheikh Kassim Nsubuga, the acting Imam of the mosque said the court had not reinstated Sheikh Ssebisubi.
“The magistrate only ruled that he was unlawfully removed from office and did not reinstate him. We are going to sit with our lawyer to forge a way forward,” Sheikh Nsubuga observed.
Sheikh Nsubuga also said that they would not allow Sheikh Ssebisubi to run the mosque.
Sheikh Ssebisubi said: “If they block me from running the mosque as directed in Magistrate’s ruling, then the police will intervene and arrest them.”

The women were on Wednesday at Namabwere primary school in Nawandala Sub County. They had gathered in their respective groups to receive over 300 chickens from Hon Alibaawo in her campaign to improve the livelihood of women in Iganga district. Each group was given 50 chicken as start-up capital in their journey to prosperity. Read what some leaders said; Ms Naigambi Lydia from Nawandala Trading Centre says, “They solicited money from us through opening bank accounts and depositing Shs80,000. They also asked for land titles and land agreements from us yet we don’t have such things. I was informed that I needed to have a business with a capital of Shs4m yet my capital was very small.” The chairperson Kisoboka Saving Group in Nawandala Ms. Nakagolo Faith said they were not able to join the program. This is given the many conditions attached. She also asked their woman MP to raise their concerns to the relevant offices. The MP condemned the mode of implementation of the program. She cited that it has turned to benefit the well-off class of women other than the intended group. She further asked the government to intervene saying the current strings attached to the programme are very tight to accommodate a common woman. GROW project is a Government of Uganda initiative that arose out of the need to respond to the needs of women entrepreneurs. This is especially those who want to grow their businesses, sustain their self-employment and create more jobs.
